They were options both years, and were bypass, not full flow filters. I don't have one in my '40, and change the oil every 1000 miles. With modern detergent oils, a longer interval probably wouldn't hurt anything, but 1000 is just easier for me to remember.

I agree 100% with 4dfordsc. The filters were not very efficient back then. With today's oils and frequent changing I see little reason to install a filter.
And yes, they were options in both years. A correct '39 filter with the proper hoses and fittings is extremely difficult to locate.
A proper '40 filter housing is fairly common. The proper hoses and especially the fittings and clamps, well, they are TOUGH to find.
The correct '39 filter is within the photograph...

Phil, with your setup, an original or even a '40 model filter wouldn't look good and would be a pain to install. I'd certainly run a beehive filter with an engine like yours. Mount it on the firewall and run flex hoses to the engine. You likely have a 59A engine, which will have a dipstick mount having the return fitting. Get the supply from the oil pressure sender boss. Nothing else is required but to be certain there is a built in restrictor on the intake side of the filter housing.

As for whether it is needed, I'll say yes, as it performs two mechanical functions for you:
Your oil is filtered 100% on every day trip.
The extra oil capacity provides that much more cooling capacity, as your oil system is as important as your cooling system in your engines ability to run cool.
A Beehive filter looks cool in any engine compartment anyway.

An oil filter is not necessarily "needed" but a good thing to have IMO. How many modern vehicles, or other equipment using internal combustion engines, have you seen lately without an oil filter?
If or when I rebuild a flathead engine I do what's necessary to add a full flow oil filter system.
If I were not running a filter on my engine I would plan on changing the oil every 1000-1500 miles, or once a year, whichever came first. As someone else said, with todays detergent oils you should not get the internal sludge buildup like these engines got in the past using non detergent oils.
